On January 21, 2010, Toyota Motor Company issued a formal recall notice in the United States covering 2.3 million vehicles "to correct sticking accelerator pedals." Toyota has explained that the recall was necessary because "[i]n rare instances, there is a possibility that certain accelerator pedal mechanisms may mechanically stick in a partially depressed position or return slowly to the idle position." Toyota has also issued similar recall notices in countries in Europe, South America and Asia. To date, more than eight million Toyota cars have been recalled worldwide due to the sudden and unintentional acceleration problem.

Nearly two hundred suits have been filed concerning Toyota and its handling of unintended acceleration matters in U.S. federal and state courts.

On April 9, 2010, the United States Judicial Panel on Multidistrict Litigation (MDL) issued a Transfer Order wherein it decided that all cases against Toyota Motor Company should be consolidated in the United States District Court Central District of California. The MDL panel selected Judge James V. Selna to preside over the litigation and coordinate pretrial discovery, where potentially damaging internal Toyota documents will be turned over to litigants.
